This website is operated by James Angele, trading as Bokeh Club Australia, ABN 80 975 806 472, based in Victoria, Australia. In these terms, “we”, “us” and “our” refer to that business. Contact bokehclubau@outlook.com.
These terms describe use of bokehclub.com.au and customer accounts. Digital purchases are also governed by the Product Terms and Refund Policy. Our Privacy Policy explains how personal information is handled.
The website is currently a preview. Purchases and giveaway entries are not open. Displaying a product, guide or future service does not mean it is currently available to order. Available checkout options and any specific promotion conditions will be shown before you commit to a purchase or participation.
Using the website
You may browse the website and use available account features for lawful purposes. Provide accurate information when using an account, making an enquiry or placing an order. If you are not legally able to enter a purchase contract yourself, obtain the involvement of a parent or guardian or other authorised person. Any promotion may have its own minimum age and location requirements.
Do not attempt to bypass authentication or download controls, access another person's account, interfere with site security, misuse payment processes, upload malicious material or use the service in a way that infringes another person's rights.
Your account
An account is associated with the email address you use to sign in. Protect that inbox and keep sign-in links private. Contact us promptly if you believe someone has obtained unauthorised access or if an account or order appears under the wrong email.
Your account may show purchases, download entitlements and, where applicable, promotional entries. Contact us if a record appears incorrect. We may reasonably verify account or order ownership before changing access or disclosing order information.
We may restrict access where reasonably necessary to investigate suspected fraud, an account compromise, unlawful use or a material breach of these terms. Where appropriate, we will explain the restriction and provide a way to contact us. We will consider the circumstances, act proportionately and preserve any remedies required by law. Asking for a refund or making a genuine complaint is not itself grounds to suspend an account.
Products, prices and payment
Product descriptions, inclusions, formats and prices are shown on the relevant product pages. Prices are in Australian dollars unless clearly stated otherwise. The total payable is presented before payment, including any applicable tax or mandatory charges. Digital pack purchases are one-time payments, not recurring subscriptions.
A purchase must be made through an enabled checkout. A request or failed payment attempt does not create a paid order. Once payments are enabled, the identified provider processes payments; we do not store complete card numbers or security codes. Fulfilment follows verified payment and the delivery information provided for the product.
For digital purchases, read the Product Terms. If we introduce physical products, their condition, inclusions, sourcing status, delivery estimates, costs and applicable return arrangements will be disclosed before purchase. A photography guide or camera reference resource is not a physical camera order.
Intellectual property
Website content and downloadable resources are owned by us or used with permission, subject to any identified third-party rights. You may use the site for its intended purpose. Permission to use a purchased resource is described in its Product Terms; purchasing a file does not transfer ownership of the source material.
You retain ownership of your own photographs and original material. Do not reproduce, sell or publicly distribute our paid resources without permission, or imply an endorsement that we have not given. Third-party product names are used to identify the equipment or subjects discussed and do not imply affiliation or sponsorship unless expressly stated.
Giveaways and other promotions
A giveaway is open only when its published page says so and its entry conditions are available. A digital purchase is not automatically an entry into a future giveaway. If an eligible purchase includes promotional benefits, those benefits and the applicable terms must be disclosed before purchase.
The Giveaway Terms and promotion-specific rules govern eligibility, dates, entry allocation, prizes, winner selection and notification. Any required authorisations and entry restrictions must be established for the particular promotion before it opens; these website terms do not establish a permit exemption. Those terms do not remove your rights concerning the product you purchased. No statement on this site guarantees that a payment provider has approved a particular promotion model.
Information and external links
Photography guides and camera buying references provide general practical information. Results depend on the equipment, film, processing and circumstances. Information about a model does not certify the condition of a particular second-hand unit. Consult current manufacturer or laboratory instructions and a suitably qualified repairer where appropriate.
External links may take you to websites operated by others. Check their terms and privacy information. We do not control third-party websites. This does not limit any responsibility we have for our own descriptions, statements or products under applicable law.
Availability and consumer protection
We take reasonable steps to operate the website reliably, but maintenance, provider outages and security issues can interrupt it. If an interruption affects a paid order, we will help restore delivery or arrange an appropriate remedy. We do not use an outage statement to exclude applicable consumer guarantees.
Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. These terms do not require you to give up claims for losses that we are legally responsible for. The Refund Policy explains how to contact us about a product problem.
Changes and disputes
We may update these terms for future use of the website. Changes to purchase conditions do not retrospectively reduce the rights or material inclusions of an existing order. Where a material change affects an existing service, we will give any notice and provide any remedy required by law.
If a concern arises, contact us so we can try to resolve it. You remain free to seek assistance from an applicable regulator, consumer protection body, payment provider or court. Victorian and applicable Australian laws govern these terms, without displacing any mandatory protections that apply to you or requiring you to use an exclusive complaint process.
