Giveaway Terms & Conditions

These terms apply to every giveaway run by Bokeh Club Australia (Bokeh Club, we, us). Each giveaway also has its own page on bokehclub.com.au. The details on that page (the giveaway's name, when it opens and closes, when the winner is drawn, the prize and its value, who can enter and how the winner is announced) form part of these terms for that giveaway. If the giveaway page and these terms ever differ, the giveaway page applies.

Entering a giveaway, or buying a package that includes complimentary entries, means you accept these terms, our Terms of Service, Privacy Policy and Refund Policy.

Who runs the giveaways

The promoter is Bokeh Club Australia. The promoter's legal name, ABN, address and contact email are shown on each giveaway page, under Key Details.

What kind of promotion this is

Our giveaways are trade promotion lotteries run to promote Bokeh Club products and membership. You don't pay for an entry. Qualifying Bokeh Club packages give you the product or access described on the package, and also include the stated number of complimentary entries into the giveaway shown on the package.

Who can enter

You can enter if you are 18 or older and live in one of the states or territories listed on the giveaway page.

You can't win if you are:

• a director, employee or contractor of Bokeh Club;
• involved in running or drawing the giveaway;
• an immediate family member of, or living in the same household as, any of those people.

We may ask the winner for proof of age, identity and address before the prize is awarded. If the winner isn't eligible, the prize goes to a redraw.

How entries work

Every package shows the product or access you're buying, how long any access lasts, the number of complimentary entries it normally includes, any bonus that applies, and which giveaway the entries are for.

Entries are only issued once your payment has been confirmed, and only for purchases completed after the giveaway opens and before it closes. Each entry gets its own entry number and is linked to you, your order and that giveaway. You can see your entries in your account. Entries can't be transferred, sold or swapped for cash, and they only count for the giveaway they were issued for.

Bonus entry periods

From time to time we run bonus periods, such as 2X or 5X entries. A bonus period has a fixed start and finish time that is shown on the giveaway page before it begins, and we don't change it once people have bought under it. For example, a package that normally includes 5 complimentary entries includes 25 during a 5X period. A purchase gets the bonus if its checkout is started during the bonus period and paid for in that same checkout.

Refunds and chargebacks

If a purchase is refunded, reversed or charged back before the draw, the entries that came with it are cancelled and aren't included in the draw. If only part of an order is refunded, we adjust the entries to match what you kept.

Nothing in these terms takes away your rights under the Australian Consumer Law.

The draw

The draw takes place at the time shown on the giveaway page, at the promoter's business address unless the giveaway page says otherwise. When the giveaway closes, the list of entries is locked, cancelled entries are removed, and the winner is chosen at random from all remaining eligible entries by our secure electronic draw system. Every eligible entry has the same chance of winning. Each draw is recorded so it can be checked later. You don't need to be at the draw to win.

Winners

We contact the winner by email using the details on their account, and may also call. Where the law requires it, the winner's name or initial and state are published on our Winners page, as described on the giveaway page.

The winner has 28 days from the draw to reply and confirm they are eligible. If we can't reach them or confirm their eligibility in that time despite reasonable efforts, we hold a redraw at 12:00 pm Melbourne time on the next business day, at the same place and by the same method, and contact the new winner the same way.

Prizes

Each prize is described on the giveaway page, including its value, condition and what's included. Most prizes are pre-owned cameras: we test them and describe their condition honestly, and the photos show the actual prize unless the giveaway page says otherwise.

We send the prize to the verified winner within Australia, insured and free of charge, within 28 days of the draw. Prizes can't be exchanged for cash. If a prize becomes unavailable, we may replace it with one of equal or greater value where the law allows, and the winner agrees.

Your information

We use the information you give us to run the giveaway: recording entries, checking eligibility, running the draw, contacting the winner, delivering the prize and announcing the winner where required. We only send you marketing if you have agreed to it, and you can unsubscribe at any time. Our Privacy Policy has the full details.

Fair play

We may disqualify anyone who tampers with a giveaway, enters using false details or tries to get an unfair advantage. If a giveaway is affected by fraud, technical failure or anything else outside our reasonable control, we may pause, change or cancel it, subject to any directions from the relevant authorities.

Apart from your rights under the Australian Consumer Law, Bokeh Club isn't responsible for entries that are lost, late or incomplete because of technical problems, or for any loss from taking part in a giveaway or using a prize, except where caused by our negligence.

Records and changes

We keep records of entries, payments, draws and prize delivery for at least three years after each giveaway ends.

We may update these terms for future giveaways. Changes never apply to a giveaway that has already opened. The version that applied to your entry is the one linked from your order.

These terms are governed by the laws of Victoria, Australia.
